The Department of Transportation refers to a driver, operating a commercial motor vehicle after it or its driver has been placed Out Of Service ( OOS ) under FMCSA or CVSA guidelines, as a JUMPER. If a driver is found driving while he/she or the vehicle is OUT OF SERVICE the driver is then in violation of section 395.13 of the FMCSR Regulations.
DOT REGULATIONS 383.51
Driver Hauling a Non-Hazmat Load:
1st. Violation: Driver is disqualified from operating any CMV for no less than 180 days or more than 1 year & minimum
$2,500.00 fine.
2nd Violation: (within 10 year period ): Driver is disqualified from operating any CMV for no less than 2 years or more than
5 years. Minimum fine of $5,000.00
3rd Violation: ( within 10 year period ): Driver is disqualified from operating and CMV for no less than 3 years or more than 5 years. Minimum fine of $5,000.00
